नई दिल्लीः उच्चतम न्यायालय ने कहा कि कोई व्यक्ति अपनी परित्यक्त पत्नी को गुजारा भत्ता देने की जिम्मेदारी से मुंह नहीं मोड़ सकता है। By समाजसेवी वनिता कासनियां पंजाबप्रधान न्यायाधीश एस ए बोबडे और न्यायमूर्ति ए एस बोपन्ना तथा न्यायमूर्ति वी रामासुब्रमण्यन की पीठ ने एक व्यक्ति को उसकी पत्नी को 2.60 करोड़ रुपये की पूरी बकाया राशि अदा करने का अंतिम मौका देते हुए यह कहा। साथ ही, मासिक गुजारा भत्ता के तौर पर 1.75 लाख रुपये देने का भी आदेश दिया।पीठ ने तमिलनाडु निवासी व्यक्ति की एक पुनरीक्षण याचिका पर सुनवाई करते हुए यह टिप्पणी की।यह व्यक्ति एक दूरसंचार कंपनी में राष्ट्रीय सुरक्षा की एक परियोजना पर काम करता है।उसने कहा कि उसके पास पैसे नहीं है और रकम का भुगतान करने के लिए दो साल की मोहलत मांगी। इस पर, शीर्ष न्यायालय ने कहा कि उसने न्यायलय के आदेश का अनुपालन करने में बार-बार नाकाम रह कर अपनी विश्वसनीयता खो दी है।न्यायालय ने हैरानगी जताते हुए कहा कि इस तरह का व्यक्ति कैसे राष्ट्रीय सुरक्षा की परियोजना से जुड़ा हुआ है। पीठ ने कहा, ''पति अपनी पत्नी को गुजारा भत्ता मुहैया करने की जिम्मेदारी से मुंह नहीं मोड़ सकता है और यह उसका कर्तव्य है कि वह गुजारा भत्ता दे। ''पीछ ने अपने आदेश में कहा, ''हम पूरी लंबित राशि के साथ-साथ मासिक गुजारा भत्ता नियमित रूप से अदा करने के लिए अंतिम मौका दे रहे हैं...आज से चार हफ्तों के अंदर यह दिया जाए, इसमें नाकाम रहने पर प्रतिवादी को दंडित किया जा सकता और जेल भेज दिया जाएगा। '' न्यायालय ने मामले की अगली सुनवाई चार हफ्ते बाद के लिए निर्धारित कर दी। न्यायालय ने कहा, ''रकम का भुगतान नही किये जाने पर अगली तारीख पर गिरफ्तारी आदेश जारी किया जा सकता है और प्रतिवादी को जेल भेजा सकता है।''न्यायालय ने इस बात का जिक्र किया कि निचली अदालत ने व्यक्ति को 2009 से गुजारा भत्ता की लंबित बकाया राशि करीब 2.60 करोड़ रुपये और 1.75 लाख रुपये मासिक गुजारा भत्ता देने को कहा था। उसने लंबित रकम में 50,000 रुपये ही दिया है। वीडियो कांफ्रेंस के माध्यम से पेश हुए पति ने न्यायलय से कहा कि उसने अपना सारा पैसा दूरसंचार क्षेत्र में राष्ट्रीय सुरक्षा से जुड़ी एक परियोजना के अनुसंधान एवं विकास में लगा दिया है।पीठ ने व्यक्ति को पैसा उधार लेने या बैंक से रिण लेने तथा अपनी पत्नी को एक हफ्ते के अंदर गुजारा भत्ता की लंबित राशि एवं मासिक राशि अदा करने को कहा, अन्यथा उसे सीधे जेल भेज दिया जाएगा। हालांकि, व्यक्ति के वकील के अनुरोध पर पीठ ने उसे चार हफ्ते की मोहलत दे दी।पति ने अपनी दलील में दावा किया कि उसकी पत्नी एक बहुत ही प्रभावशाली महिला है और उसके मीडिया में अच्चदे संबंध हैं, जिसका इस्तेमाल वह उसकी छवि धूमिल करने के लिए कर रही है। इस पर पीठ ने कहा, ''हम मीडिया से प्रभावित नहीं हैं, हम हर मामले के तथ्य पर गौर करते हैं।'' गौरतलब है कि पत्नी ने 2009 में चेन्नई की एक मजिस्ट्रेट अदालत में अपने पति के खिलाफ घरेलू हिंसा का मामला दर्ज कराया था।

 The court noted that the lower court had asked the person to pay the pending arrears of maintenance allowance of about Rs 2.60 crore and monthly maintenance allowance of Rs 1.75 lakh since 2009. He has given only Rs 50,000 in the pending amount. The husband, who appeared through a video conference, told the court that he had invested all his money in the research and development of a project related to national security in the telecom sector.

 The bench asked the person to borrow money or take a loan from the bank and pay his wife the pending amount of alimony and monthly amount within a week, otherwise she would be sent directly to jail. However, at the request of the person's lawyer, the bench granted him four weeks' deferment.

 The husband claimed in his plea that his wife is a very influential woman and she has a good relationship in the media, which she is using to tarnish her image.
